WA Drink Driving Repeat offender
A repeat drink driving offender is a license holder who has been charged and convicted of a variety of drink driving offenses. It does not matter if he was convicted for a novice drink driving offense or for a low-range, mid-range or high range drink driving offense for the first or subsequent times, all these drink driving offenses are considered when deciding upon the penalty.
One peculiar feature of Western Australia’s drink driving laws is that the penalties are graduated from the first offense, second offense and other subsequent offenses. The penalty of fine for the first offense is the same in the first, second and subsequent offenses but the penalty of disqualification is longer for the second and subsequent offenses.
Repeat drink drivers are also required to undergo alcohol interlock in lieu of the disqualification. The only complication is that the alcohol interlock is for a minimum period of 6 months. Removing the alcohol interlock on a repeat offender’s vehicle is subject to good behaviour which means no drink driving in the meantime.
