WA Drink Driving Mid Range
The blood alcohol concentration of a person who is holding a regular driver’s license is considered mid range when it is higher than 0.08% but not higher than 0.15%. This traffic offense may be charged against drivers who hold regular or open driver’s licenses or even those who are subject to the 0.0% BAC. The peculiarity of the Western Australia drink driving offenses is that the penalties for mid range drink driving offenses are also graduated to five levels.
If the BAC is higher than 0.08 but not higher than 0.09%, the penalty range is between $500- $1500 and the disqualification is for 6 months for the first offense, 8 months for the second offense and 10 months for a subsequent offense.
If BAC is higher than 0.09% but not higher than 0.10%, the penalty range is between $550 and $1500 and the disqualification is for 7 months for the first offense, 10 months for the second offense and 13 months for a subsequent offense. The penalties are graduated for BAC levels between higher than 0.10%- not higher than 0.11%, higher than 0.11% but not higher than -.13% and higher than 0.13% but not higher than 0.15%.
