WA Drink Driving Low Range
The blood alcohol concentration of a person who is holding a regular driver’s license is considered low range when it is higher than 0.05% but not higher than 0.08%. This traffic offense may be charged against drivers who hold regular or open driver’s licenses or even those who are subject to the 0.0% BAC. The peculiarity of the Western Australia drink driving offenses is that the penalties for low range drink driving offenses are also graduated.
If the BAC is higher than 0.05% but not higher than -.07%, then the penalty range is between $500- $1000 and the disqualification from driving is for six months if it is the first offense and 8 months if it is a second offense. If the BAC is higher than 0.07% but not higher than 0.08%, then the penalty range is between $600 and $1000 and the disqualification from driving is for eight months for the first offense and 10 months for the second offense.
