Police in Western Australia are empowered by law to randomly stop motorists on the roadway in order to ask their names, addresses, and also to produce their driver’s licenses. The police are also empowered to require motorists to provide breath samples for the breath analyser machines to determine their blood alcohol content while driving on the road. The motorist cannot refuse any of these requests by the police when he is stopped by them on the roadway.
Also, it is a separate and distinct drink driving offense for a motorist to refuse to give a breath sample. It is also a drink driving offense to refuse to give a blood or urine sample for a confirmatory test for the presence of alcohol or drugs in the suspected drink driver’s blood.
One peculiarity of the law in Western Australia is that the police are empowered to issue not only an infringement notice to the suspected drink driver but also issue an automatic disqualification notice which will stop him from driving for two months.
