Drink Driving Refuse Breath Analysis

Refusing a breath analysis when requested by police is a serious offense as defined under Section 55 of the Road Safety Act of 1986. Penalties may include the driver’s license being cancelled for a period of up to two years. There will also be demerit points made against the driver’s license.

This offense of refusing a breath analysis may be committed in different ways: if the police stops you and asks you to breathe into a breath analyser device while at the roadside and you refuse; or if you are required by the police to take a confirmatory test at the station or at a breath testing site; or if you fail or refuse to stop your vehicle at the breath test analysis site; or if you refuse to have your blood or saliva tested for blood alcohol concentration at the hospital after you are involved in an impact or collision. Do not refuse to give a breath, blood or saliva sample when requested.
