What to Do if Stopped by Police
The police have the power to randomly stop any vehicle to ask the driver his name, address and to ask him to produce his driver’s license. The police also have the power to request the driver to give a breath sample so that his blood alcohol concentration can be determined. The driver cannot refuse the police’s request even if the driver feels that he has not committed any traffic or drink driving offense.
Even when the breath analyser machine gives a reading that the driver’s BAC is not within the prescribed alcohol limits, if the police has a reasonably suspects that the driver is under the influence of alcohol or a drug, the police can require the driver to go to the station and give a saliva or blood sample for a confirmatory test. The driver cannot refuse this police request.
When the police ask the driver any other questions aside from his name and address, the driver can politely decline to answer them. The driver is not required to assist the police in gathering evidence against himself.
