In Queensland, a person who is randomly stopped for a breath analyser test and whose blood alcohol concentration is higher than the allowable blood alcohol limit for the type of license he holds will be issued a traffic infringement notice. This traffic infringement notice is more than just a traffic violation ticket.

This infringement notice is actually a charge, conviction and sentence for a drink driving offense issued by a police officer at the roadside. It results in the immediate disqualification of the person’s driver’s license within 24 hours if he holds a learner’s, provisional, probationary or restricted license.

It also results in the disqualification of the driver’s license for more than 24 hours and until the scheduled court ate for drivers whose BAC was in mid-range or between 0.10% but not more than 0.15%. The immediate disqualification of the driver is a measure of protection for the safety of all the users of the roadway by keeping a drunk driver from being on the roadway.
