Drug Driving Offences QLD

Drug driving is an offence similar to drink driving. The person however is tested not for blood alcohol content but for illicit drugs present in the saliva or in the blood. It is however considered a lesser offence compared to drink driving. But if the person was arrested for driving while under the influence of drugs, this is now considered a serious offence.

In 2009, random roadside drug testing was implemented in Queensland. The tests were mostly done through an oral saliva test or through a blood sample test or urine sample test if the offender cannot give a saliva sample to obtain the presence of THC (an active ingredient in Cannabis), speed or ice, and ecstasy.

If during the initial saliva test the offender was found negative, he is immediately released. Those who were found positive were then brought to the police station to be tested for the second time. If the offender was found positive on any of the illicit drugs, his driver license is suspended for 24 hours, and the remaining saliva will be brought to the laboratory for confirmation. When the result was released, the said offender will be notified and the charges against him which is a traffic offence for drug driving is filed in the magistrate court.
