Dealing with the Police QLD
Please note that the police are authorized to stop any vehicle and require the driver or person in charge of the vehicle to provide breath, saliva or blood samples to determine the driver’s blood alcohol content. Do not resist the police when they stop you or when they request a sample of body fluid from you. To resist giving a body fluid sample is also a traffic offense for which you can be penalized.
Once you are stopped on the road, the police can ask your name, your address and they can ask you to produce your driver’s license. Refusing to give your name, address or refusing to provide your driver’s license are also traffic offenses for which you can be penalized.
Once the breath analyzer registers a blood alcohol content that is within the prescribed content of alcohol for your type of license (0.0%, 0.5% or higher), the police will bring you to the station for a confirmatory blood or saliva test. Go with the police. Do not resist or else you can also be charged with another traffic offense.
Remember that a PCA or drink driving charge can always be contested in court and a conviction can always be appealed.
