Special range drink driving offense
Special range drink driving is an offense committed by those drivers holding a special category driver license. He is a holder either of a learner or provisional driver license, or one who does not hold a driver license because of the following reasons, to wit: his driver license was cancelled or suspended, or he was disqualified from obtaining a driver license, or he tried to apply for a driver license but his application was refused or denied, or he was never issued a driver license. One is also a holder of a special driver license when he was driving a motor vehicle in New South Wales and he has no authority to do so.
Special range drink driving is the offense committed when the prescribed content of alcohol on the special category driver was at 0.02 but below 0.05 blood alcohol content when arrested. And the penalty imposed if committed for the first time within the last five years is a fine of $1, 100.00. If the offense was committed for the second of more time, the maximum penalty of $2, 200.00 will be applied.
Anent the penalty of license disqualification, the court has the discretionary authority not to record the conviction. In such a case, the convicted driver will have no conviction record and shall not be held liable to pay the fine and serve any disqualification period.
If the court chooses to convict the driver, a conviction record will be entered against his name and he shall suffer the penalty of license disqualification period which is a minimum of three months and maximum of 6 months if the offense was committed for the first time within the last five years. If the commission of the offense was a subsequent one, the minimum disqualification period is six months and the maximum or automatic disqualification period is twelve months.
