License Disqualification
Conviction of any drink driving or drug driving or dangerous driving offenses by any person will earn him the penalty of license disqualification, the period of which varies based on the nature of the offense committed. If the offense of drink driving was committed for the first time, the license disqualification period runs for up to a minimum period of three months to a maximum of three years.
The minimum period of three months applies only to those convicted of novice range drink driving offense for the first time. Losing a driver license or to be disqualified to drive for a certain period entails a severe hardship to those whose income are dependent on their employment as a driver. Violating the directive of the court disqualifying a person to drive will make that person liable for disqualified driving.
Sometimes license disqualification is also understood as license cancellation. This is different from license suspension which is immediately imposed by the police authorities upon arrest or within 48 hours from arrest. License disqualification or cancellation is a penalty imposed by the magistrate court after conviction and which forms part of the penalty for the offense committed aside from fines and bonds.
The effect of license disqualification as a penalty of conviction for committing a drink driving offense is that, the driver is prohibited to drive a motor vehicle or to attempt to put a motor vehicle in motion or to sit as a supervising driver of a learner driver for a certain period. However, when that disqualification period ends, the convicted and disqualified driver can drive a motor vehicle again. It is always recommended that before attempting to drive a motor vehicle, the disqualified driver must first check whether his disqualification period has already ended or still running. Otherwise, he will be facing a new charge which is driving while disqualified.
