Driving Under the Influence of Drugs

A defence to this charge is that a person was not the one in charge of the vehicle operating in a public road or area when he or she was stopped for breath analysis test, or that he or she was not operating in a public road or area. It is the obligation of the police officers to prove beyond reasonable doubt that the person charged is actually the one seated on the driver’s seat and in charge of the vehicle operating on a public road or was trying to set in motion the said vehicle.
Section 10 of the Crimes (Sentencing Procedure) Act gives the Court the discretion not to record a conviction against a person charged with any offence. These are often sought after, particularly in relation to drink driving charges.
